Real estate

Is a lawyer mandatory in an apartment transaction?

There is no legal obligation, but a sale agreement is a complex document and mistakes can be very costly. In practice both sides are represented in the vast majority of transactions — each by its own attorney. More on the real estate page.

What is a cautionary note (he'arat azhara)?

A registration in the Land Registry warning of a commitment to transact in the property. It protects the buyer against conflicting transactions and is usually registered shortly after signing the agreement.

Can I handle an Israeli matter while living abroad?

In many cases yes — signatures can be arranged through notarized powers of attorney coordinated with your location, funds can move through trust accounts, and updates arrive by email and WhatsApp.

Wills & inheritance

What happens when there is no will?

The estate is divided under the Succession Law's default rules — usually half to the spouse and half to the children. The statutory division does not always match the deceased's wishes. More in our article on wills.

What is the difference between an inheritance order and a probate order?

An inheritance order is issued when there is no will and determines the heirs by law; a probate order gives legal effect to an existing will. Both are filed with the Registrar of Inheritance Affairs. Full guide here.

Can an existing will be changed?

Yes. As long as the testator is competent, a will can be changed or revoked at any time — and a later will prevails. It is worth reviewing after major life events.
